Consumer Rights – Withdrawal – Cancellation and Return Conditions

GENERAL:

1. When you place an order electronically on our website, you are deemed to have accepted the preliminary information form and the distance sales contract provided to you.

2. Buyers are subject to the provisions of Law No. 6502 on the Protection of Consumers, the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), and other applicable laws concerning the sale and delivery of purchased products.

3. Buyers shall bear the shipping costs (delivery fees) for the product.

4. Each product purchased shall be delivered to the person or organization at the address indicated by the buyer within a maximum legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

5. The purchased product must be delivered completely, in accordance with the specifications stated in the order, and accompanied by any warranty certificates, user manuals, or similar documents, if applicable.

6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within three days of becoming aware of the situation and refund the total amount paid by the buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

7. If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product ceases.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

8. If it is determined after the delivery of the product that the payment was made with a credit card used unlawfully by unauthorized persons, and if the product price is not paid to the seller by the related bank or financial institution, the buyer must return the product to the seller within three days, with shipping costs borne by the seller.

UNFORESEEN CIRCUMSTANCES DELAYING PRODUCT DELIVERY:

9. If unforeseen circumstances beyond the seller’s control prevent timely delivery of the product, the buyer shall be informed. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is resolved. If the buyer cancels the order:
   • If payment was made in cash, the amount will be refunded within 14 days.
   • If payment was made by credit card, the amount will also be refunded to the bank within 14 days. However, the bank may take 2-3 weeks to transfer it to the buyer's account.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

10. The buyer must inspect the product or service subject to the contract before accepting delivery and should not accept damaged or defective goods (e.g., crushed, broken, torn packaging). Delivered goods are deemed to be free of damage and defects. After delivery, the buyer must carefully protect the goods. If the withdrawal right is exercised, the product must not be used, and it should be returned with its invoice.

RIGHT OF WITHDRAWAL:

11. The buyer has the right to withdraw from the contract without any legal or criminal liability and without providing a reason within 14 (fourteen) days from the delivery date of the purchased product to themselves or to a third party at the specified address. Notification of withdrawal must be made to the seller using the contact information below.

13. If the purchased product is a service, this 14-day period starts from the signing of the contract. The right of withdrawal cannot be exercised for service agreements where the service has commenced with the buyer’s approval before the withdrawal period ends.

14. Costs arising from the exercise of the right of withdrawal shall be borne by the seller.

15. For the right of withdrawal to be exercised, the buyer must notify the seller in writing within the 14-day period using registered mail, fax, email, or other methods specified by the seller. The product must not have been used under the provisions outlined in the "Products for Which the Right of Withdrawal Cannot Be Exercised" section of this contract.

EXERCISING THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to the buyer or a third party must be returned (if the invoice is issued to a company, a return invoice must also be issued).
17. Products must be returned with their box, packaging, standard accessories (if any), and in an undamaged and complete condition.

CONDITIONS FOR RETURN:

18. Upon receipt of the withdrawal notification, the seller must refund the total price and any documents that place the buyer under financial obligation within 10 days and accept the return of the product within 20 days.

19. If there is a reduction in the value of the goods due to the buyer’s fault or if the return becomes impossible, the buyer must compensate the seller for the loss. However, the buyer is not responsible for changes or deterioration caused by proper use of the goods within the withdrawal period.

20. If the exercise of the right of withdrawal reduces the total amount below the campaign limit, the discount provided under the campaign shall be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

21. Products that are prepared according to the buyer's requests or explicitly tailored to their personal needs, underwear items, swimwear, cosmetics, perishable goods, goods with expired shelf life, and goods unsuitable for return due to health or hygiene reasons, where the packaging has been opened after delivery, cannot be returned.

22. Certain categories such as books, digital content, software programs, DVDs, CDs, and similar products cannot be returned if their packaging is opened.

DEFAULT AND LEGAL CONSEQUENCES:

24. If the buyer defaults on a credit card payment, they accept liability under their credit card agreement with the bank. The bank may initiate legal proceedings and demand additional costs and attorney’s fees from the buyer.

PAYMENT AND DELIVERY:

25. Payments can be made via bank transfer or EFT to the designated bank accounts provided on the website.
26. Online payment options via credit card allow single or installment payments. Upon successful payment, the order amount will be deducted from the credit card.
